Rules

This policy of the Debrecen Wine and Jazz Days, organised by Főnix Rendezvényszervező Közhasznú Nonprofit Kft (Főnix) (’Főnix non-profit limited liability company for event organisation’), includes the mandatory entry and conduct rules for the event. Any rights and obligations arising from the legal relation between Főnix and any people entering the event (Visitor) are set forth in the General Contractual Terms and Conditions of Debrecen Wine and Jazz Days.

I. ENTRY TO THE EVENT

1./
Visitors may enter the event within the time limits and under the conditions set by the ticket bought.

2./
When Visitors enter the event, Főnix exchanges their tickets bought in advance for armbands. When armbands are issued, Főnix requests the verification of identity with a photo bearing identification document to check age in the admission process but does not read, record or store the data of such identification document. If Visitor refuses to undergo the process described in the previous sentence, Főnix shall have the right to invalidate armband without any obligation to reimburse the purchase price and deny Visitor entry to Event. Visitor shall wear the armband all through the time of validity. This is checked by organisers upon entry and exit and continuously in the area of the venue. If Visitor’s armband is invalid, Visitor shall leave the venue.

Armbands are non-transferable. Primarily, an armband worn on the hand shall be deemed to be valid but if it is justified and approved by Főnix, the armband may also be worn on another limb from where it cannot be removed without getting damaged. Any damaged – stuck or cut armbands, armbands with a broken stud or with a diametre bigger than the hand or armbands tampered with in any other way, etc. – shall be deemed to be invalid. Főnix will not substitute or replace a damaged or lost armband. Főnix will take legal action against anybody forging tickets or contributing to such forging.

Simultaneously with the handover of the armband, Főnix will provide Visitor with a tasting glass. Visitors under 18 years of age are exceptions to this. 1 tasting glass is provided with each entry ticket and season ticket. No lost, damaged or broken glasses may be replaced free of charge. Visitor may get a replacement for a lost, damaged or broken glass in the booth appointed to sell glasses.

3./
In order to organise the Event safely, Főnix reserves the right to impose restrictions on the objects and devices that may be brought to the venue. Thus, it is particularly forbidden to bring to the area of the venue any drugs, fireworks, objects containing explosive, toxic or flammable substances, firearms, knives with a cutting edge longer than 8 centimetres, butterfly knives, switchblades, gas sprays, blackjacks, expandable batons, metal chains longer than 50 centimetres, throwing stars, catapults or any other objects especially dangerous for public safety and set forth in the currently effective legal statute on objects especially dangerous for public safety, currently in government decree No. 175/2003. (X. 28.).
Drones may only be brought to the area of the venue and used there if Visitor possesses both Főnix’s preliminary written permit and any licenses necessary for the operation of such drone. Visitor may not enter the venue with any prohibited objects.

4./
Visitor shall not have the right to bring any alcoholic drinks to the venue. In case of a heat alarm ordered by the National Public Health and Medical Officer Service, (mineral) water may be brought to area of the venue in quantities reasonably necessary to satisfy personal needs, otherwise, Visitor shall have the right to bring bottled water or soft drinks in one PET bottle of maximum 0.5 litre capacity. Visitor shall not have the right to bring food or tobacco products to the venue in commercial quantities. In case of food, any quantities exceeding the quantity reasonably necessary to satisfy personal needs shall be deemed to be a commercial quantity. In case of tobacco products, any quantities exceeding 2 cartons (20 packets) of cigarettes, 10 boxes of cigarillos and (regardless of size) 10 cigars shall be deemed to be commercial quantities.

Children under 14 (fourteen) years of age may attend Event free of charge but it is mandatory for them to wear an armband. The attendant shall write the child’s name and the attendant’s telephone number on such armbands. Children’s armbands may be requested upon entry. Children under 14 (fourteen) years of age may only enter the area of the venue and may only stay there accompanied by an attendant who is of age and has full capacity.

Without a permit issued by Főnix, you are forbidden to drive into the area of the venue. Any person possessing a permit to drive in shall also fully comply with the regulations of the Highway Code during the event. It is recommended to get to the event by means of public transport or by taxi.

7./
It is forbidden to bring any bicycles into the area of the venue. Please, leave your bike in one of the facilities designated for parking bicycles. Visitors shall assume responsibility for their bikes left in such facilities.

8./
Beyond the service dogs, guide dogs and police dogs as defined in legal statutes, only such domestic animals (pets, typically, dogs, ferrets, certain rodent species, etc.) may be taken free of charge and only by their masters to the area of the venue which are, according to public opinion, tame, present no hazard to the Visitors’ or others’ life, health or physical integrity and may be put on a lead. It is not recommended to bring any pets to the area of the venue. Főnix recommends that pets be left at home or accommodated in special pet hotels and not be taken to the Event. Pets may be admitted to the area of the venue if all the following conditions are complied with: (i) valid immunisation records certifying vaccination against rabies not earlier than one year ago, (ii) individual identification (readable tattoo or microchip), (iii) lead, collar, muzzle, a tag with the master’s telephone number (at which the master can also be contacted during the event). The availability of the above may be checked at the entrance to the Event, and in case of any deficiency, the pet cannot be granted entry. Upon bringing a pet to the event, Visitor agrees to keep it in such a hygienic way which is suitable for the animal, too. Upon bringing a dog or ferret to the Event, Visitor agrees to keep it on a lead and to make it wear a muzzle during the whole time of the Event. For the sake of the safe implementation of the Event, Főnix reserves the right to forbid bringing any specific animals to the Event, continuously check compliance with the above provisions and ban any animals not complying with the regulations.

Főnix recommends that in order to avoid any inconvenience, Visitor fulfil the following conditions in case of bringing any service dogs as provided for in SZMM (Ministry of Social Affairs and Labour) decree No. 27/2009. (XII. 3.). In case of guide dogs and therapy dogs helping handicapped people, with regard to the special function of the dog’s mouth, it is not mandatory but recommended for the dog to wear a muzzle. If Főnix thinks that the service dog responds to the extreme audiovisual impulses in a different way from how it was trained or that it is too sensitive, it may require Visitor to put a mouth strap or probably a muzzle on the dog. Visitor shall be responsible for bringing a service dog to the Event. If a service dog behaves in a way different from the conduct acquired in training, it may be banned from the area of the venue.

II. RULES OF CONDUCT

In the area of the venue, Visitor shall behave complying with general norms according to any relevant legal regulations, the General Contractual Terms and Conditions and the policy. Visitor shall refrain from any conduct, communication or action that may endanger, violate or harm others’ personality rights, lives, health or physical integrity. In the area of the venue, Visitor shall particularly protect and shall refrain from damaging natural values. Főnix requests Visitors to put any garbage in the bins.

2./
Visitor understands that Főnix, contractual partners, contributors, representatives of the press (pursuant to the provisions in the special contract applicable to them), other Visitors and other third parties getting permission from Főnix may make sound and image recordings of the Event. Accordingly, by participating in the Event, Visitor expressly gives his/her consent to the recording and disclosing of his/her face, appearance and conduct with the stipulation that his/her name may only be disclosed with his/her consent. If Visitor is deemed to be a public personality, his/her name may be dsclosed without such consent. In the visualisations pursuant to the above, the person who makes them shall obtain an unlimited, transferable and exclusive right of use in space, time and manner of use with respect to Visitor. In relation to Visitor, Főnix and any persons getting permission from Főnix shall have an unrestricted right to utilise, use (in particular, for the purpose of popularising the Events), multiply, publish, rework, make public, convey to the public and market such visualisations without any obligations to give any compensation to Visitor fot it in any manner. Visitor specifically agrees that Főnix records Event and the concerts and programmes, multiplies, distributes and broadcasts such recordings on image storage media or conveys them to the public in any other manner, repeatedly broadcasts or conveys them to the public in any other manner, including the case when the Event or the concerts and the programmes are made available to the public through lines or with any other device or in any other manner (e.g. through YouTube) in the way that members of the public may individually choose the place and time of access. In connection with such visualisations, Visitor shall not have the right to raise any claims or demands against Főnix. Visitor shall have the right to make any sound or image recordings at the Event with the provision that Visitor may only do so with an image and sound recorder integrated into a telecommunication device solely used for personal purposes (e.g. mobile telephone, tablet) or with non-professional photographic equipment and shall not sell, utilise for compensation or without compensation for commercial purposes any image or sound recordings made by him/her, shall not have the right to name any Visitors appearing in such recordings and shall not violate their personality rights. Főnix expressly excludes any liability if other Visitors fail to comply with the above.

3./
In the area of the venue, including the area in front of the entrance to the Event, it is forbidden to conduct any business, trading or advertising activities without Főnix’s preliminary written permission.

4./
In the trading and catering outlets, it is forbidden to serve alcoholic drinks to any people under eighteen years of age or any drunken people. In case of disorderly conduct, Főnix shall have the right to call upon Visitor to leave the event. It is forbidden to consume any substances qualified as drugs pursuant to effective law in the area of the venue, and it will be punished by law.

6./
For the safety of the Visitors, it is forbidden to make a fire at the Event.

7./
With regard to the fact that the purpose of the Event is to provide civilised and undisturbed entertainment for Visitors, it is forbidden to organise any demonstrations unrelated to the events organised by Főnix at the Event irrespective of the number of participants. Notwithstanding the above, Főnix reserves the right to permit some demonstrations on the basis of organiser’s preliminary request at its sole discretion with the provision that participants shall comply with this policy in such a case, too, and otherwise, behave in such a way that does not disturb, restrict, prevent or make impossible other Visitors’ entertainment, or movement in the area of the venue, entry to or exit from the area of the venue, or the use of Services and/or Products by any other Visitors. Főnix shall have the right to put an end to any demonstrations not expressly permitted, without giving justification and Főnix also reserves the right to put an end to any demonstrations permitted by it pursuant to the above, without giving justification. At its sole discretion, Főnix shall have the right to determine the specific conditions, in particular, the number of participants, place and time of the demonstration. If Főnix declares a demonstration finished, participants shall immediately stop it. If with regard to a demonstration preliminarily permitted or acknowledged by it, Főnix sets conditions, participants shall fully comply with such conditions.

8./
In the area of the venue, Főnix’s qualified staff having the relevant licenses ensure the enforcement of any conduct and safety rules. By participating in the Event, Visitor expressly agrees that he/she will extensively cooperate with such staff members subject to the legal statutes and follow their instructions in case of emergency. If Visitor wishes to lodge a complaint concerning the acts of these people, Visitor may send his/her complaint to email address info@fonixinfo.hu or send it by mail to Főnix Rendezvényszervező Közhasznú Nonprofit Kft. 4026 Debrecen, Hunyadi u. 1-3.

9./
Visitor agrees that in or above the area of the venue, video recordings may only be made or photos may only be taken involving the use of drones with Főnix’s preliminary written consent and complying with all the relevant legal regulations, without endangering the safety of participants or the Event. The person making such recordings shall negotiate with Főnix in advance concerning the manner and time of making such recordings and get Főnix’s approval.

III. OTHER PROVISIONS

1./
Főnix shall only be held liable for any deliberate breach of contract or such breach of contract that causes damage to human life, physical integrity or health, and beyond the rights that Visitor has pursuant to legal statutes, Főnix expressly excludes its liability for any other case of damage. The price of the ticket has been determined taking the above exclusions into consideration.

2./
At the Event, Főnix does not operate a left luggage office or safe deposit boxes. In the parking places near the event, Főnix provides no guarding. Therefore, with regard to the motor vehicles parked there or any objects placed in them, Főnix’s liability is excluded.

3./
Any tickets bought may only be returned if the event is cancelled by the organiser or if the event cannot be held due to unfavourable weather conditions. It is Főnix’s intention to start or continue the advertised event even under doubtful weather conditions. Therefore we recommend that in case of expected unfavourable weather conditions you bring warm and waterproof clothes with you, as well.
In case of unfavourable weather conditions, communication about the cancellation of the event will be published on websites www.fonixinfo.hu and www.boresjazz.hu by 8 p.m. on the day preceding the day of the event the latest. If no communication is published, Főnix is preparing to hold the event. Főnix reserves the right to cancel the event/ any day of the event also on the spot.

If in case of unfavourable weather conditions on the spot, half of the concert programmes scheduled for the day has been completed, the event day shall be deemed to have been held.
If two consecutive event days are cancelled, the event shall be deemed to be cancelled.

In case of any technical obstacles or unfavourable weather conditions, Főnix’s management will make a decision concerning the delayed start or the continuation of the interrupted event on the spot.

If the event (customers having bought season and day tickets) /any day of the event (customers having bought day tickets) is cancelled, any tickets bought will be repurchased where they were bought in opening hours within 5 days of the first workday following the event cancelled. Ticket offices cannot repurchase any tickets beyond such deadline. Ticket offices on the spot or any ticket offices involved in the sales of tickets for this event may not be obliged to repurchase any tickets. Tickets cannot be repurchased on the spot on the day of the event cancelled.

No tickets bought may be repurchased if Visitor leaves the interrupted event, which is continued later on the same day upon weather conditions having become more favourable.

IN CASE OF VIS MAIOR: Should Buyer or Főnix be unable to fulfil their contractual obligations as a result of a war, revolt, terrorist act, strike, accident, fire, blockade, flood, act of God, severe energy supply problems or any other unforeseeable and unavoidable hindrance that is beyond Buyer’s or Főnix’s control, such person shall not be held liable for any loss or damage that occurs as a result of such events.

4./
Főnix reserves the right to change the programme.

5./
Any Visitors who stay in the area of the venue with armbands not entitling them to stay there or without armbands understand and agree that simultaneously with being held liable, they shall pay the price of the armband (or the proper difference). If Visitor fails to do so, he/she will lose his/her right to further attend Event on account of his/her extraordinary termination, nor may he/she raise any claim or demand against Főnix on account of this.

6./
With any remarks, complaints or ideas concerning catering, the organisers or anything else, you may turn to staff members at the ticket selling points marked on the map. You can also give any lost property to them or inquire about any lost property with them.
